Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TorosHosting cloud hosting platform, websites, dashboards, APIs, and related services (collectively, the "Service"), operated by Emails&More("TorosHosting", "we", "us", or "our"). By creating an account, deploying a server, or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility & accounts

You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We may suspend or terminate accounts that we reasonably believe have been compromised, used to violate these Terms, or registered with false information.

2. Wallet, billing & pricing

The Service is billed on a prepaid wallet basis. You top up your wallet, and we debit it hourly for each running server based on the published rate for the chosen plan. Prices are displayed in Indian Rupees (₹) and may include or exclude taxes as indicated. We may change pricing at any time; changes apply only to usage after the change takes effect and will be communicated through the dashboard or email.

Hourly charges already consumed are non-refundable. Unused wallet balance may, at our sole discretion, be refunded to the original payment method, subject to our Refund Policy. Promotional credits are non-refundable and may expire.

If your wallet balance reaches zero, we may suspend, power off, or destroy your servers without further notice. You remain responsible for any negative balance arising from chargebacks, failed payments, or fraud.

3. Customer responsibilities

• You are solely responsible for the content, software, and data you deploy on the Service.
• You are responsible for backups. While we provide snapshot and backup features, you must verify they meet your recovery needs.
• You must comply with our Acceptable Use Policy and with all applicable laws.
• You must keep your software, operating systems, and configurations up to date and secure.

4. Service availability

We aim to provide a reliable service and operate to the targets described in our Service Level Agreement. The Service is otherwise provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or perfectly secure operation, and we may perform scheduled or emergency maintenance from time to time.

5. Suspension & termination

We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if (a) you violate these Terms or the Acceptable Use Policy; (b) your account creates legal, security, or operational risk for us, our infrastructure, or other customers; (c) payment fails or your balance becomes negative; or (d) required by law or by a government authority. On termination, your right to use the Service ends, and we may delete your data after a reasonable grace period.

You may close your account at any time by destroying your servers and contacting support.

6. Intellectual property

The Service, including all software, designs, trademarks, and content provided by us, is owned by Emails&More or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain ownership of the content and data you upload.

7. Limitation of liability

To the maximum extent permitted by law, TorosHosting, Emails&More, our affiliates, and our suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Service is limited to the amounts paid by you to TorosHosting in the three (3) months immediately preceding the event giving rise to the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless TorosHosting, Emails&More, and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the Service, (b) your content or data, (c) your violation of these Terms or applicable law, or (d) your violation of any rights of a third party.

9. Modifications

We may update these Terms from time to time. Material changes will be communicated via the dashboard or email at least seven (7) days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

10. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable mandatory consumer-protection laws, the courts located in India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
